Alito Dissents from Rejection of Anti-Abortion Student's Appeal in Free Speech Case

The Supreme Court's Justice Alito dissented from the rejection of an anti-abortion student's appeal in a free speech case.

He was the sole dissenter on Monday from the court's refusal to hear the case of an anti-abortion student who founded a pro-life club at her Indiana high school.

Alito stated in his dissent that the student, who is a minor, had requested permission to hang flyers at school to promote the club, but the school refused, citing that the flyers contained pictures of students holding placards that read "Defund Planned Parenthood."

The justice argued that the case highlighted a critical issue that needed to be resolved by the high court regarding how lower courts apply student speech precedents.

He contrasted the 1969 case of Tinker v. Des Moines Independent Community School District with the 1988 case of Hazelwood School District v. Kuhlmeier, stating that the lower courts have struggled to determine the precise limits of Hazelwood.

Alito stated that he would have granted the student's petition to clarify the relationship between Hazelwood and subsequent government-speech decisions.

The appeals court that ruled against the student stated that the school's actions were in line with both the nature of the school walls as a limited forum for student expression and its broader pedagogical duty to create a stable and neutral educational environment.

The court also stated that the student's flyers had caused trouble because they contained political slogans and images, and the school administrators instructed her to revise them to comply with the school's neutral content rules.

Alito's dissent highlights the importance of the issue and the potential implications for student speech and free expression.

Dissents like Alito's are significant because they bring attention to issues that are crucial to the writing justice and any other justices who join them.

It takes four justices to grant review, and the denial of the student's petition appeared on the Supreme Court's order list.

Other notable actions on Monday's list included Alito dissenting, joined by Justice Clarence Thomas, from the denial of Alabama's petition in a death penalty case, and the court granting review in a case about jury trial rights for next term, which starts in October.

The Supreme Court will continue to issue its final decisions before breaking for the summer, with the final rulings usually coming by July.
